What is bad faith insurance?

Insurance bad faith is the wrongful and unreasonable denial of an insured person’s insurance claim by the insurer. The insurance policy between insured and insurer is a contract that requires the insurer to act in “good faith” towards the insured. If the insurer withholds the benefits of the policy, it is considered bad faith.

Bad faith can be demonstrated by the insurer in a variety of ways, including the failure to effectively investigate a claim, delaying payment, denying benefits to a claim, using unreasonable interpretations in applying policy language, and refusing to reasonably adjust the insured’s loss. It can be extremely frustrating and difficult for the insured party to deal with their insurer during a bad faith case, but fortunately an attorney can help ease this process and fight on behalf of the insured.
